Terms & Conditions — Hywal
By purchasing any service from Hywal, you agree to the following Terms & Conditions. This agreement defines the rights, responsibilities, and obligations between you (“the Client”) and Hywal (“the Company”). Please read carefully before placing any order or using our services.
1. Collaboration & Communication
- 1.1 Service Delivery: Hywal provides digital creative services, including 3D visuals, mockups, and branding assets. Clear communication and timely feedback are essential for a smooth collaboration. Approving a delivery or design concept is considered final — further revisions may require an additional fee.
- 1.2 Process & Deliverables: All designs and visuals are created specifically for each client. Final deliveries may include multiple formats (e.g., PNG, JPEG, or other digital formats) depending on the service purchased.
- 1.3 Original Work: Hywal guarantees that all work is original and created exclusively for the client. We do not use pre-made templates or stock assets in final deliverables unless otherwise agreed.
- 1.4 Communication Channels: All communication takes place via email or the platform used during your order. Hywal does not offer phone consultations unless explicitly included in a custom plan.
- 1.5 Client Delays: Once an order is placed, our team begins preparation. If the client fails to provide the required information or feedback within 10 days, the project may be paused without refund eligibility.
2. Payment & Refunds
- 2.1 Payment: All payments are made securely via our online system ( Dodo Payments). Services are prepaid in full before production begins.
- 2.2 Refund Policy: Refunds are governed by our Refund Policy. By purchasing a service, you acknowledge that you have read and accepted those terms.
- 2.3 Pricing: Prices are subject to change without notice. Orders confirmed before any change will not be affected.
3. Ownership & Intellectual Property
- 3.1 Rights Transfer: Upon full payment, the client receives full usage rights for the final designs, visuals, or other digital deliverables.
- 3.2 Hywal’s Portfolio Rights: Hywal retains the right to showcase completed work (mockups, 3D renders, brand visuals) in its portfolio or promotional materials unless the client explicitly requests confidentiality in writing.
- 3.3 Unpaid Work: Until payment is completed, Hywal retains all ownership and intellectual property rights to any created content. The client may not use, share, or reproduce any draft or visual before full payment.
4. Client Responsibilities
- 4.1 Accuracy of Information: The client agrees to provide accurate project details, branding materials, and feedback required to deliver the service.
- 4.2 Usage of Final Designs: The client is solely responsible for the way the final designs or visuals are used publicly or commercially.
- 4.3 Approval: Once final deliverables are approved, Hywal is not responsible for further modifications or errors not reported before approval.
5. Confidentiality
Any information shared by the client (project briefs, internal data, or strategy documents) is treated as strictly confidential. Hywal will not disclose such information to any third party without written consent, except as required to deliver the service or by law.
6. Limitation of Liability
Hywal is not liable for indirect, incidental, or consequential damages resulting from the use or inability to use its services. Our total liability under any claim shall not exceed the amount paid for the service in question.
7. Disputes & Chargebacks
- 7.1 Payment Disputes: All charges are considered valid unless disputed within 14 days of the transaction date.
- 7.2 Resolution First: Clients agree to contact Hywal first to attempt a resolution before filing any payment dispute with their bank or payment processor.
- 7.3 Legal Recourse: If a chargeback is filed without prior communication, Hywal reserves the right to pursue recovery of the disputed amount and any associated fees.
8. Service Modifications
Hywal reserves the right to update or modify its services, pricing, or procedures at any time, as long as such changes do not affect ongoing confirmed projects.
9. Governing Law
These Terms & Conditions are governed by the laws applicable in the country where Hywal operates. Any disputes shall be handled in good faith and, if necessary, resolved through competent local courts.
